
Swiss Supreme Court judgement of 20 July 2017
The Swiss Supreme Court judged on the Russian Federation's challenge of a Swiss-seated Arbitral Tribunal's Interim Award on jurisdiction.
The Swiss Supreme Court (on 20 July 2017) judged on the Russian Federation’s challenge of a Swiss-seated Arbitral Tribunal’s Interim Award on jurisdiction, by which the Arbitral Tribunal addressed three out of five objections raised against its jurisdiction. The Swiss Supreme Court ruled that the challenge was premature.
The arbitral proceedings in question concern a claim for damages brought by a Luxembourg company controlled by the Yukos oligarchs (Yukos Capital) in relation to supposed “loans” made to Yukos Oil in Russia before Yukos Oil was declared bankrupt.
